General Terms and Conditions of Sale

Argana Mobility is your partner for mobility in Morocco, for both individuals and businesses.
We offer a complete car rental service without driver, designed to allow you to travel with peace of mind and simplicity.

These General Terms and Conditions of Sale (GTCS) aim to define a clear, transparent, and secure framework applicable to all reservations made via our website.

DEFINITIONS – KEY TERMS TO KNOW

For a proper understanding of these GTCS, the terms below shall have the following meanings:

  • Argana Mobility / the COMPANY: the company providing car rental services without a driver.
  • RENTER: any natural or legal person (individual or company) making a reservation.
  • Vehicle: the vehicle rented by the RENTER for the duration of the rental.
  • Rental: the period from the moment the vehicle is handed over until its effective return.
  • Deposit: an amount paid as a guarantee, which may be partially or fully retained in the event of costs attributable to the RENTER.
  • Deductible: the amount remaining payable by the RENTER in the event of a responsible accident.
  • Unlimited mileage: no limitation on the number of kilometers driven during the rental period.
  • Jawaz: electronic toll system allowing access to Moroccan highways.
  • No-show: failure of the RENTER to appear on the scheduled date without prior cancellation in accordance with the GTCS.

1. PURPOSE – RESERVATION – PARTIES

These GTCS govern the conditions of car rental without a driver offered by Argana Mobility via its website, for the benefit of individuals and businesses.

Any reservation implies full and unconditional acceptance of these GTCS.

The rental is concluded for a fixed duration, specified at the time of reservation.

2. Vehicle – Availability – Delivery – Return

The vehicle is delivered to the RENTER in good working and visual condition, in accordance with the information provided at the time of reservation.

The RENTER acknowledges the apparent condition of the vehicle upon pickup.
Any apparent defect or anomaly must be reported to Argana Mobility within three (3) hours following delivery of the vehicle.
After this period, the vehicle shall be deemed compliant and accepted without reservation.

Vehicle delivery

Vehicle delivery is free of charge in Rabat and Marrakech.

For delivery to any other city, delivery fees may apply depending on the distance between the vehicle’s departure location and the requested delivery location.
These fees are communicated to the RENTER before confirmation of the reservation.

The RENTER undertakes to return the vehicle, along with all accessories and documents, at the agreed place, date, and time, in a condition identical to that observed at delivery, excluding normal wear and tear.

In the event of failure to return the vehicle or documents at the agreed date and time, the rental shall continue, and the RENTER shall remain fully responsible for the vehicle and all associated costs until its effective return.

3. Conditions of Use and Responsibilities

The rental is personal and non-transferable.
The vehicle may only be driven by the RENTER or by expressly authorized drivers.

To be authorized to drive the vehicle, the driver must meet the following conditions:

  • Be at least 21 years old,
  • Hold a valid driving license for at least 3 years,
  • Foreign driving licenses are accepted.
    An additional driver may be added free of charge, subject to meeting the same conditions.

The RENTER undertakes to use the vehicle only on roads open to motor traffic, in compliance with safety rules and the applicable Highway Code.

It is strictly prohibited to:

  • Tow, push, or pull another vehicle or trailer,
  • Make any modification, alteration, or addition to the vehicle.

The RENTER undertakes to lock the vehicle at every stop, use the safety devices provided, and keep the vehicle keys and documents in their possession.

Any damage to the tires for a reason other than normal wear must be repaired or replaced immediately by the RENTER with tires of equivalent size and specifications.

The RENTER assumes legal and material custody of the vehicle for the entire duration of the rental, from pickup until its effective return.

4. Fuel – Maintenance – Mileage

Fuel is at the RENTER’s expense.
The vehicle must be returned with the same fuel level as noted at delivery.

In the event of return with a lower fuel level, the missing fuel will be charged per liter, plus service fees.

The RENTER undertakes to regularly check oil and water levels, at least every 1,000 kilometers.
Any breakdown or damage resulting from failure to check or insufficient levels will be charged to the RENTER.

Normal mechanical wear resulting from proper use of the vehicle is borne by Argana Mobility.
Any repair resulting from negligence, an accident, or improper use of the vehicle is borne by the RENTER.

Mileage

The rental includes unlimited mileage, with no restriction on the number of kilometers driven during the entire rental period.

5. Price – Payment – Deposit

The applicable prices are those displayed on the Argana Mobility website at the time of reservation, to which delivery fees may be added depending on the city and distance.
They take into account, in particular, the rental duration, the selected vehicle, and any chosen options.

Payment

Payment for the rental may be made, depending on the option selected at the time of reservation:

  • 100% online payment on the website, or
  • Payment upon return of the vehicle.

When payment is made online, the accepted payment methods are:

  • Credit card,
  • Apple Pay,
  • Google Pay,
    depending on the payment solutions available at the time of reservation.

Credit card payments may be subject to additional fees of 3%.
These fees may be negotiated or adjusted depending on the rental duration, particularly for long-term or professional rentals.

When payment is made upon return of the vehicle, the accepted payment methods are:

  • Cash.
  • Bank transfer.

Deposit (Security Deposit)

A deposit of 6,000 MAD is required for all vehicles.

The deposit may be paid:

  • In cash.
  • By credit card pre-authorization.

The deposit is refunded within 5 to 7 business days after the vehicle is returned, subject to banking processing times.

The deposit may be partially or fully retained in the event of costs attributable to the RENTER, including but not limited to:

  • Damage to the vehicle.
  • Late return.
  • Missing fuel.
  • Fines or violations.
  • Non-compliant cleanliness condition.
  • Missing documents or accessories.

6. Insurance and Claims

The vehicles offered by Argana Mobility are insured in accordance with the insurance policies in force taken out by the Company.

Insurance and Deductible

In the event of a responsible accident, the RENTER remains liable for a deductible equal to 5% of the claim amount, with a minimum of 6,000 MAD, regardless of the damage incurred.

In the event of a non-responsible accident, no deductible is applied to the RENTER, subject to compliance with the obligations set out in these GTCS.

Theft and fire are covered by insurance, provided that the RENTER returns all vehicle keys and documents and complies with the reporting procedure.


The insurance does not cover the RENTER in the event of driving under the influence of alcohol, drugs, or any substance prohibited by law.
In such cases, all damages and related costs shall remain entirely the responsibility of the RENTER.

Claim reporting

Any claim (accident, theft, fire, or damage) must be reported immediately to Argana Mobility.

The report must include in particular:

  • The place, date, and time of the incident.
  • The circumstances.
  • Any witnesses and be accompanied by the necessary documents, including an accident report when required.

The RENTER undertakes not to acknowledge any liability and not to enter into any settlement with third parties without the prior consent of Argana Mobility.

Personal belongings left in the vehicle are not covered by insurance.

7. Delay – Extension – Cancellation – Options

Late return

A 2-hour grace period is granted beyond the scheduled return time.
After that, a delay equivalent to half a day will be charged at 50% of the daily rate.

Rental extension

The rental may be extended only subject to vehicle availability and with the prior approval of Argana Mobility.

Cancellation and no-show

A refund may be granted only:

  • In the event of exceptional weather conditions.
  • Upon presentation of relevant supporting documentation.

Cancellation must occur no later than 7 days before the vehicle pickup date.

In the event of a no-show, the same conditions apply.
Failing this, no refund will be issued.

Options and Equipment

Jawaz (Electronic toll)
The vehicle may be equipped with a Jawaz device provided free of charge.
Toll fees remain at the RENTER’s expense.
In the event of loss or damage, the RENTER will be charged for the cost of the device as well as the remaining balance.

Baby / Child seat

A baby or child seat may be provided upon request.
The price displayed at the time of reservation is a fixed fee, based on the applicable exchange rate, and valid for the entire rental period.
In the event of loss or damage, the RENTER undertakes to fully reimburse the equipment.

8. Fines – Personal Data – Jurisdiction

The RENTER remains solely responsible for fines, penalties, and violations committed during the entire rental period.
Any amount advanced by Argana Mobility in this respect may be re-invoiced to the RENTER.

Personal data collected during the reservation process is processed in accordance with the privacy policy available on the Argana Mobility website.

These General Terms and Conditions of Sale are governed by Moroccan law.
In the event of a dispute, the courts of Rabat shall have exclusive jurisdiction.
